Withdrawal of consent

You have the free and unrestricted opportunity to withdraw your consent for the above data management purposes, i.e. direct marketing and sending newsletters, at any time, without providing any reasons. The data subjects may exercise this right by sending a message to the email address adatkezeles@powerbizt.hu, or, in case of eDM, by clicking on the “Unsubscribe” button at the bottom of the message (with immediate effect).

Contributors and employees of Power Kft. participating in data management and data processing, entitled to do so, are entitled to access data to the extent justified by their duties and capacities performed in data management, within a regulated framework. Colleagues working in these capacities view the data generated, analyze them, and erasure them based on the data subjects’ request.

Your rights in relation to data management

The data subject’s right to access/provision of information

The data subject is entitled to receive information from the Controller as to whether his/her personal data is being managed, and if so, the data subject is entitled to access to his/her personal data and the following information:

  • Purpose of the data management;
  • Categories of the data subject’s personal data;
  • Planned duration of storage of personal data, or if this is not possible, the criteria for determining this period;
  • Recipients or categories of recipients to whom the personal data has been or will be disclosed, including in particular third country recipients and international organizations. If personal data are transferred to third countries or international organizations, the data subject is entitled to receive information about the appropriate guarantees required by the GDPR regarding the transfer;
  • If the data were not collected from the data subject, all available information about their source;
  • The data subject’s right to request from the Controller the rectification, erasure or restriction of management of the personal data concerning him/her, as well as to object to the management of such personal data;
  • The right to file a complaint at a supervisory authority;
  • The fact of automated decision-making, including profiling, as well as, at least in these cases, comprehensible information about the applied logic and the significance of such data management, furthermore, its expected consequences for the data subject.

Power Kft. shall make a copy of the personal data subject to data management available to the data subject. For additional copies requested by the data subject, the Controller may charge a reasonable fee based on the administrative costs. If the data subject submitted the request electronically, the information shall be provided in a commonly used electronic form, unless the the data subject requests otherwise.

Right to rectification

At the request of the data subject, the Controller shall rectify inaccurate personal data concerning him/her without undue delay. Taking into account the purpose of the data management, the data subject may also request the completion of incomplete personal data.

Right to restriction of data management

At the request of the data subject, the Controller shall restrict the data management if one of the following conditions is fulfilled:

  • The Controller no longer needs the personal data for the purpose of data management, but the data subject requires them to file, enforce or protect legal claims;
  • The data management is unlawful, the data subject objects to their erasure, and instead of erasure, the data subject requests the restriction of the use of the data;
  • The data subject disputes the accuracy of the personal data. In this case, the restriction lasts as long as the Controller is able to verify this;
  • The data subject objects to the data management; in this case, the restriction applies to the duration until it is established whether the Controller’s legitimate grounds take precedence over the data subject’s legitimate grounds.

If data management is subject to a restriction, such personal data may only be managed for the following purposes and under the following legal basis, except of storage:

  • with the data subject’s consent;
  • due to an important public interest of the EU or a Member State; or
  • to file, enforce or protect legal claims, or to protect the rights of other natural or legal persons.

If the restriction of data management is lifted, Power Kft. shall inform the data subject in advance thereof, at whose request the data management was restricted.

Right to object

For reasons related to own situation, based on legitimate interests, the data subject may object to the management of his/her personal data, including profiling, at any time. In this case, the personal data may no longer be managed, unless the Controller proves that the data management is justified by its legitimate interests, which take precedence over the data subject’s interests, rights and freedoms, or which are connected to file, enforce or protect legal claims.

In case of data management for the purpose of direct marketing, the data subject may object to the management of his/her personal data for this purpose, including profiling, at any time if it is related to direct marketing. If the data subject objects to the management of personal data for the purpose of direct marketing, his/her personal data may no longer be managed for this purpose.

Right to erasure ("right to be forgotten")

At the request of the data subject, the Controller shall erase the personal data concerning him/her without undue delay. In addition, the Controller shall erase the personal data concerning the data subject without undue delay if:

  • The personal data has been managed unlawful;
  • The data subject withdrawn its consent, provided that there is no other legal basis;
  • The data subject objects to the data management and there is no legitimate ground for data management that takes precedence;
  • The personal data are no longer needed for the purpose for which they were collected or otherwise managed;
  • The erasure is required by a legal obligation prescribed by the law of the EU or a Member State.

If the Controller has disclosed the personal data and it shall erase it pursuant to the above, taking into account the available technology and the costs of implementation, it shall take all the reasonably expected steps, including technical measures, to inform other controllers managing the data that the data subject requested the erasure of the links to the personal data in question, or the erasure of the copy or duplicate of this personal data.

Erasure of the data is prohibited if the data management:

  • is necessary to fulfill an obligation under the law of the EU or a Member State, requiring the management of personal data;
  • is necessary to file, enforce or protect legal claims (for example, the data are needed in court proceedings, for use as evidence);
  • is necessary to exercise the right of freedom of expression and information;
  • is necessary for archiving purposes in the public interest, scientific and historical research or statistical purposes, and the erasure would make the data management impossible, or it would severely endanger it.

Right to Data Portability

The data subject is entitled to the following:

  • to receive the personal data concerning him/her provided to the Controller in a structured, commonly used and machine-readable format;
  • to transmit these data to another controller without being prevented by the Controller to whom the data subject provided the personal data; furthermore,
  • to request the direct transfer of the personal data between controllers if it is technically feasible.

This right can be exercised if the data management is based on consent or a contract and the data management is performed by automated means.

Right to Legal Remedy

If you believe that you have been wronged in relation to the management of your personal data, please inform us at the above email address, and we will do our best to remedy it.

Nevertheless, all data subjects are entitled to file a complaint at a supervisory authority, in particular, at the authority located in the Member State of his/her usual residence, his/her workplace, or at the place of the presumed infringement, in the event of a violation of the management of personal data concerning him/her.
