Power Kft. (hereinafter: Company), as the controller, hereby discloses information on the data management performed in the framework of the website and the services related to the website, based on Articles 13(1) and (2) of the GDPR.

In general, website visitors do not need to provide their personal data to use the website. However, during and in connection with browsing the website, the Company collects data in order to make the website available, provide the services offered there, improve the services available on the website, detect and prevent abuses, measure website views, improve user experience, as well as for statistical purposes, which in certain cases may involve the management of personal data.

Withdrawal of consent

You can withdraw your consent at any time, giving consent is voluntary. The data subjects may exercise this right by sending a message to the email address adatkezeles@powerbizt.hu, or, in case of eDM, by clicking on the “Unsubscribe” button at the bottom of the message (with immediate effect).

In connection with pop-up windows and pop-up advertisements, the Company uses the customer experience optimization application of OptiMonk International Zrt. [Körbefuttatás-törés] (Seat: H-4028 Debrecen, Kassai út 129.).

Social media platform

The Company operates a Facebook fan page called Techson, where it provides information about its products and offers, as well as displays a general information content. Inquiring parties having a Facebook profile may join the page and follow us by clicking on the Like button and the Follow button.

The inquiring parties may also contact the Controller on Facebook, they can express their opinion under the posts and send messages.

The fans and followers of the Techson Facebook page are identifiable to the Company, i.e. the Controller can view their profiles and it has access to the information they have made accessible to the Company in the Facebook Privacy Settings menu.

On Techson’s Facebook fan page, it is possible to comment and like the posts, or express opinion by sending other emoticons. If the data subject believes that others may also be interested in the content, under the posts, the data subject can draw attention to the content by writing “@” and the person’s name. The Company never requests such a tag, it is the user’s own decision.

The Company shall not be liable for any data content and comments published on its social media by its business partners that are in breach of any laws. The Company shall not be liable for any errors and malfunctions arising from the operation of the social media platform, and for any issues arising from changing the operation of the system, which affect the protection of the personal data.

Facebook pixel (Facebook cookie)

The Facebook Pixel code has been incorporated into the https://techson.hu/ website and its subpages, based on which Facebook can track the activities of users registered on Facebook on these websites. By means of this, the advertisements are only displayed to previous visitors of the website. This is called remarketing. By Facebook Pixel, we are able to target segmented groups (selected according to certain criteria) with our advertisements. By Facebook Pixel, we can measure the success of our Facebook advertisements and posts, as Facebook is able to track the activities of the data subjects on our website after visiting our Facebook page.

The Facebook fan page may transfer personal data to the USA. Currently, the USA is an unsafe third country from a data protection point of view, on the one hand, because the access rules of third parties do not comply with the basic principles of the GDPR (for example, too extensive access for public bodies), and on the other hand, the provisions of rights to data subjects does not comply with the EU legislation either. If a visitor performs any activity on the Controller’s Facebook page, he/she is aware of the above and the risks.

Links to external websites

The website may contain links to websites of third parties. By clicking on these, the server of the third party will be directly connected to the computer used by the visitor. In this case, the data management on the website of the operator of the external service is performed by the third party concerned, in accordance with its own Privacy Policy. The website currently contains a link to the website of the following third party: Youtube.com. This link/these links may be subjected to continuous change.

Your rights in relation to data management

The data subject’s right to access/provision of information

The data subject is entitled to receive information from the Controller as to whether his/her personal data is being managed, and if so, the data subject is entitled to access to his/her personal data and the following information:

  • Purpose of the data management;
  • Categories of the data subject’s personal data;
  • Planned duration of storage of personal data, or if this is not possible, the criteria for determining this period;
  • Recipients or categories of recipients to whom the personal data has been or will be disclosed, including in particular third country recipients and international organizations. If personal data are transferred to third countries or international organizations, the data subject is entitled to receive information about the appropriate guarantees required by the GDPR regarding the transfer;
  • If the data were not collected from the data subject, all available information about their source;
  • The data subject’s right to request from the Controller the rectification, erasure or restriction of management of the personal data concerning him/her, as well as to object to the management of such personal data;
  • The right to file a complaint at a supervisory authority;
  • The fact of automated decision-making, including profiling, as well as, at least in these cases, comprehensible information about the applied logic and the significance of such data management, furthermore, its expected consequences for the data subject.

Power Kft. shall make a copy of the personal data subject to data management available to the data subject. For additional copies requested by the data subject, the Controller may charge a reasonable fee based on the administrative costs. If the data subject submitted the request electronically, the information shall be provided in a commonly used electronic form, unless the the data subject requests otherwise.

Right to rectification

At the request of the data subject, the Controller shall rectify inaccurate personal data concerning him/her without undue delay. Taking into account the purpose of the data management, the data subject may also request the completion of incomplete personal data.

Right to restriction of data management

At the request of the data subject, the Controller shall restrict the data management if one of the following conditions is fulfilled:

  • The Controller no longer needs the personal data for the purpose of data management, but the data subject requires them to file, enforce or protect legal claims;
  • The data management is unlawful, the data subject objects to their erasure, and instead of erasure, the data subject requests the restriction of the use of the data;
  • The data subject disputes the accuracy of the personal data. In this case, the restriction lasts as long as the Controller is able to verify this;
  • The data subject objects to the data management; in this case, the restriction applies to the duration until it is established whether the Controller’s legitimate grounds take precedence over the data subject’s legitimate grounds.

If data management is subject to a restriction, such personal data may only be managed for the following purposes and under the following legal basis, except of storage:

  • with the data subject’s consent;
  • due to an important public interest of the EU or a Member State; or
  • to file, enforce or protect legal claims, or to protect the rights of other natural or legal persons.

If the restriction of data management is lifted, Power Kft. shall inform the data subject in advance thereof, at whose request the data management was restricted.

Right to object

For reasons related to own situation, based on legitimate interests, the data subject may object to the management of his/her personal data, including profiling, at any time. In this case, the personal data may no longer be managed, unless the Controller proves that the data management is justified by its legitimate interests, which take precedence over the data subject’s interests, rights and freedoms, or which are connected to file, enforce or protect legal claims.

In case of data management for the purpose of direct marketing, the data subject may object to the management of his/her personal data for this purpose, including profiling, at any time if it is related to direct marketing. If the data subject objects to the management of personal data for the purpose of direct marketing, his/her personal data may no longer be managed for this purpose.

Right to erasure ("right to be forgotten")

At the request of the data subject, the Controller shall erase the personal data concerning him/her without undue delay. In addition, the Controller shall erase the personal data concerning the data subject without undue delay if:

  • The personal data has been managed unlawful;
  • The data subject withdrawn its consent, provided that there is no other legal basis;
  • The data subject objects to the data management and there is no legitimate ground for data management that takes precedence;
  • The personal data are no longer needed for the purpose for which they were collected or otherwise managed;
  • The erasure is required by a legal obligation prescribed by the law of the EU or a Member State.

If the Controller has disclosed the personal data and it shall erase it pursuant to the above, taking into account the available technology and the costs of implementation, it shall take all the reasonably expected steps, including technical measures, to inform other controllers managing the data that the data subject requested the erasure of the links to the personal data in question, or the erasure of the copy or duplicate of this personal data.

Erasure of the data is prohibited if the data management:

  • is necessary to fulfill an obligation under the law of the EU or a Member State, requiring the management of personal data;
  • is necessary to file, enforce or protect legal claims (for example, the data are needed in court proceedings, for use as evidence);
  • is necessary to exercise the right of freedom of expression and information;
  • is necessary for archiving purposes in the public interest, scientific and historical research or statistical purposes, and the erasure would make the data management impossible, or it would severely endanger it.

Right to data portability

The data subject is entitled to receive the personal data concerning him/her provided to the Controller in a structured, commonly used and machine-readable format;

to transmit these data to another controller without being prevented by the Controller to whom the data subject provided the personal data; furthermore,

to request the direct transfer of the personal data between controllers if it is technically feasible.

This right can be exercised if the data management is based on consent or a contract and the data management is performed by automated means.

Right to legal remedy

If you believe that you have been wronged in relation to the management of your personal data, please inform us at the above email address, and we will do our best to remedy it.

Nevertheless, all data subjects are entitled to file a complaint at a supervisory authority, in particular, at the authority located in the Member State of his/her usual residence, his/her workplace, or at the place of the presumed infringement, in the event of a violation of the management of personal data concerning him/her.
